Grounds for a residence permit in Ukraine

By the Law of Ukraine’s  “On Immigration”, two  groups of persons receive an immigration permit and are entitled to a permanent residence permit.

The first group is persons on the immigration quota. The list of quota categories is specified in Article 4 of the Law. These include:

  • workers of culture and science necessary for the country;
  • highly qualified specialists that Ukraine needs;
  • persons who have invested at least 100 thousand US dollars in the economy of Ukraine;
  • full-blooded brother, sister, grandfather, grandmother, grandson, or granddaughter of a citizen of Ukraine;
  • persons who were previously Ukrainian citizens;
  • parents, spouse (wife), and minor children of an immigrant (a person who has received permanent residence);
  • refugees or asylum seekers (after 3 years of residence);
  • victims of human trafficking (after 3 years of status establishment).
The second group is persons who can become immigrants outside the quota. These include:

  • one of the spouses, if the second of the spouses with whom he has been married for more than two years, is a citizen of Ukraine;
  • children and parents of citizens of Ukraine;
  • persons entitled to acquire citizenship of Ukraine by territorial origin (more details can be found in Article 8 of the Law of Ukraine “On Citizenship of Ukraine”);
  • persons who are guardians or custodians of citizens of Ukraine, or who are under guardianship or guardianship of citizens of Ukraine;
  • persons whose immigration is of state interest for Ukraine;
  • foreign Ukrainians, spouses of foreign Ukrainians, and their children in case of their common entry and stay on the territory of Ukraine.

IF THE PERSON APPLYING FOR PERMANENT RESIDENCE IS IN UKRAINE, THEN THE PERMANENT RESIDENCE CERTIFICATE IS ISSUED AT THE SAME TIME AS THE IMMIGRATION PERMIT. NO SEPARATE IMMIGRATION PERMIT IS REQUIRED.
